Terms of Service

These terms are deliberately short and written in plain English. If anything here is unclear, email support@uptick.host and ask — we would rather explain it than rely on you not reading it.

1. Who we are

Uptick Host is operated by UpTick Hosting, a sole proprietorship based in Washington, located at [ADDRESS]. "We," "us," and "Uptick" mean UpTick Hosting. "You" means the person or organisation holding the account.

2. What we provide

We provide managed game server instances — primarily Minecraft — running on hardware we lease and operate. Each instance receives a defined allocation of memory, CPU, and storage as described on the plan you purchase, accessible through a control panel.

We do not provide: dedicated servers, virtual private servers, general-purpose web hosting, email hosting, or domain registration.

3. Who may hold an account

You must be at least 18 years old to hold an account and enter into these terms. If you are under 18, a parent or legal guardian must hold the account and is responsible for it, including all charges.

We do not knowingly create accounts for anyone under 13. If we learn that an account belongs to a child under 13, we will close it and delete the associated personal data.

You confirm your age when you sign up. If you misrepresent it, we may close the account without refund.

4. Your account

Keep your password and panel credentials confidential, and use a unique password. You are responsible for everything that happens under your account, including anything done by people you give access to. Tell us promptly at support@uptick.host if you believe your account has been accessed without your permission.

Keep your contact and billing details accurate. We use them to reach you about outages, abuse reports, and billing — if we cannot reach you, you may lose your server.

5. What you may and may not do

Your use of the service is governed by our Acceptable Use Policy, which forms part of these terms. Please read it — it is short, and it is the document we actually enforce.

6. Pricing, billing, and renewal

One price, always. The monthly price shown when you order is the price you will be charged on every renewal. We do not use introductory rates that increase later.

7. Cancellation and refunds

You may cancel at any time from the control panel. There is no contract term, no minimum period, and no notice period.

Our Refund and Cancellation Policy sets out the detail, including the 72-hour full refund for new customers and pro-rated refunds of unused time. It forms part of these terms.

8. Suspension and termination

We may suspend or terminate your service immediately, without notice and without refund, if:

Where the situation allows it, we will contact you first and give you a chance to fix the problem. Where it does not — active attacks, compromised servers, illegal content — we will act first and explain afterwards.

We may also terminate service for any other reason on 30 days' written notice, in which case we will refund all unused prepaid time.

9. Your data, and what happens when service ends

You own your server data. We do not claim any rights over your worlds, configurations, plugins, or files beyond what we need to operate the service and take backups.

10. Backups

We take daily automatic backups of every server, keep an off-site encrypted copy, and provide restore through the control panel at no charge. We do this because it is the right way to run a host.

You remain responsible for keeping your own copies of anything you cannot afford to lose. Backups can fail, and no backup system is perfect. Our liability for lost data is limited as set out in section 13.

11. Things outside our control

We lease our hardware and network capacity from a third-party infrastructure provider. That means some events affecting your service are genuinely outside our control, including that provider's outages, network failures, maintenance, and policy decisions.

We will always tell you honestly what has happened and what we are doing about it. But our Service Level Agreement — and the limits in section 13 — reflect the fact that we do not own the underlying facility.

12. No warranty

The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or that it will meet any particular performance expectation.

We describe our hardware and our operating practices accurately, including that we do not oversell memory. Those are commitments about how we run the platform. They are not guarantees of any specific tick rate, latency, throughput, or player capacity, all of which depend heavily on your modpack, plugins, configuration, and player behaviour.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

Read this section carefully — it limits what you can recover from us.

To the fullest extent permitted by law, our total liability to you for any and all claims arising out of or relating to the service is limited to the amount you paid us in the 3 months immediately before the event giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost goodwill, or lost or corrupted data, even if we were told such damages were possible.

Some jurisdictions do not allow some of these exclusions. Where that applies, our liability is limited to the maximum extent that jurisdiction permits.

Nothing in these terms limits liability that cannot lawfully be limited.

14. Indemnity

You agree to indemnify and hold UpTick Hosting harmless against claims, losses, damages, and reasonable legal costs arising from your use of the service, your content, or your breach of these terms or the Acceptable Use Policy.

15. Copyright and abuse complaints

We respond to copyright complaints under the DMCA and to network abuse reports. Our process, our designated agent's details, and our repeat-infringer policy are in the Acceptable Use Policy.

16. Changes to these terms

We may update these terms. If a change materially affects your rights, we will email you at least 30 days before it takes effect. Continuing to use the service after that date means you accept the change. If you do not accept it, you may cancel and receive a pro-rated refund of unused time.

We will keep previous versions available on request so you can see what changed.

17. Reselling

You may run servers for your own community, including collecting contributions from your members. You may not resell, sublet, or redistribute your allocation as a hosting service to third parties without our written agreement.

18. Assignment

You may not transfer your account without our consent. We may transfer these terms as part of a sale or reorganisation of our business, and will tell you if we do.

19. Governing law and disputes

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Washington.

Before filing anything, please email support@uptick.host. Almost everything is resolvable that way, and we would rather fix a problem than argue about it.

20. Entire agreement and severability

These terms, together with the Acceptable Use Policy, Service Level Agreement, Refund and Cancellation Policy, and Privacy Policy, are the entire agreement between us. If any provision is unenforceable, the rest remains in effect.
